1. Agreement to these terms
These Terms & Conditions are a binding agreement between you and Cognify ("Cognify", "we", "us"). By creating an account, checking the agreement box at signup, or using the service in any way, you accept these terms and our Privacy Policy. If you do not agree, do not use Cognify. When you check the agreement box at signup we record the date and time of your acceptance.
2. Who can use Cognify
- You must be at least 13 years old.
- If you are under the age of majority where you live, you may only use Cognify with the consent of a parent or legal guardian who agrees to these terms on your behalf.
- You must not have been previously suspended or removed from the service.
3. Your account
- You are responsible for your account, for everything recorded under it, and for keeping your credentials private.
- One account per person. Do not share logins, impersonate others, or misrepresent who you are.
- Tell us immediately at support@cognifygym.com if you believe your account has been compromised.
4. What Cognify is (and is not)
Cognify is a communication training platform. You record short speaking reps; we score them with automated systems and give you feedback. Cognify is a practice tool for self-improvement.
Cognify is not professional advice. Scores, feedback, coaching copy, and progress metrics are generated by automated AI systems and are provided for informational and training purposes only. They are not career, legal, medical, psychological, or financial advice, and they are not an assessment of your fitness for any job, role, or opportunity. Do not make significant decisions based solely on Cognify output. AI-generated feedback can be wrong, incomplete, or inconsistent.
5. Your content
- You own the audio you record, the transcripts of it, and your practice history.
- You give us a limited license to store, process, transcribe, and analyze your recordings solely to operate and improve the service for you (scoring, feedback, progress tracking). We do not train AI models on your audio or transcripts.
- You are solely responsible for what you record. Do not record other people without their consent, and do not record content that is unlawful, confidential, or that you do not have the right to record.
- You can export your data or delete your account at any time.
6. Acceptable use
- Do not use Cognify to harass, threaten, defame, or impersonate anyone, or to create or share unlawful content.
- Do not scrape the service, reverse-engineer it, probe or circumvent security, or attempt to access other users' data.
- Do not abuse scoring or API endpoints, evade rate limits, resell access, or use automated agents to farm scores, XP, or ranks.
- Do not upload malware or content designed to break the service or its AI systems.
We may suspend or terminate accounts that violate these rules, with or without notice, and remove offending content.
7. Third-party services
Cognify is built on third-party infrastructure and AI providers (including Supabase, Vercel, Anthropic, OpenAI, Deepgram, and Resend). Their availability affects ours. We are not responsible for outages, errors, or data handling failures caused by third-party providers, though we choose and configure them with care. The Privacy Policy lists who processes what.
8. Cognify's intellectual property
The service itself (software, design, branding, scoring methodology, exercise content, and coaching frameworks) belongs to Cognify or its licensors. These terms give you a personal, non-exclusive, non-transferable right to use the service. They do not give you any right to copy, resell, or build competing products from our content or methodology.
9. Payments
The free tier is free. Paid plans (when launched) will have clear pricing at /pricing. Prices may change with notice before your next billing cycle. Cancel anytime; refunds are handled case by case. Taxes may apply depending on where you live.
10. Termination
You can stop using Cognify and delete your account at any time from settings. We can suspend or terminate accounts that violate these terms or create risk for us or other users. When reasonably possible we will warn you first and give you a chance to export your data. If we ever shut the service down, we will give you 30 days to export your data first. Sections 4, 5, 8, and 11 through 14 survive termination.
11. Disclaimer of warranties
Cognify is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, non-infringement, accuracy, or availability. We do not warrant that the service will be uninterrupted, error-free, or secure, that scores or feedback will be accurate or useful for any specific purpose, or that any defect will be corrected. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, Cognify and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, reputational harm, or the cost of substitute services, arising out of or related to your use of (or inability to use) the service, even if we have been advised such damages are possible.
Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) 100 US dollars. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
13. Indemnification
You agree to defend and hold Cognify harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service in violation of these terms, or your violation of any law or third-party right (including recording someone without their consent).
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at support@cognifygym.com and give us 30 days to work it out informally. Claims that cannot be resolved informally must be brought individually; you waive any right to participate in a class action to the extent permitted by law. Either party may bring qualifying claims in small-claims court.
15. Changes to these terms
If we materially change these terms, we will email active users and update the "Last updated" date above. Continued use after changes take effect means you accept the new terms. If you do not agree, stop using the service and delete your account.
16. Everything else
If any part of these terms is found unenforceable, the rest stays in effect. These terms plus the Privacy Policy are the entire agreement between you and Cognify about the service. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them as part of a merger, acquisition, or sale of assets.
